The Executive Committee of PRHSAA shall appoint yearly a permanent Panel of no less than three (3) committee members and two (2) alternates to form the AC-PRSAA for that school year.

R-7 Challenge

A committee member may be challenged if the circumstances give rise to legitimate doubts over his/independence. The challenge shall be brought immediately after the ground for the challenge has become known. The challenge shall be brought by way of a petition setting forth the facts giving rise to the challenge. The Executive Committee of the PRHSAA shall rule on the challenge after the other parties, the challenged committee member and the other members have been invited to submit written comments.

R-8 Removal

A committee member may be removed by the Executive Committee of the PRHSAA if he or she refuses to or is prevented from carrying out his duties.

R-9 Replacement

In the event of resignation, death, challenge or removal of a committee member, such member shall be replaced by the Executive Committee of the PRHSAA. The proceedings shall continue without repetition of the procedure which took place prior to the replacement.

R-10 Provisional Measures

No party may apply for provisional/equitable or conservatory measures under these Procedural Rules before the statement of appeal, which implies the exhaustion of internal remedies, has been filed according to the statutes of the PRHSAA.

In agreeing to submit to these Procedural Rules any dispute subject to the appeal proceedings, the parties expressly waive their rights to request such measures from state authorities.

R-11 Expedited Procedure

With the consent of the parties, the AC-PRHSAA may proceed in an expedited manner for which it shall issue appropriate directions.

R-12 Law Applicable to the Merits

The AC-PRHSAA shall decide the dispute according to the laws of the Commonwealth of Puerto Rico.

R-13 Decision

The decision shall be made by a majority vote. The decision shall be written, dated and signed by the Chairperson of the Committee. The decision shall be final and binding upon the parties. It may not be challenged by way of an action for setting aside the decision.

B) Special Provisions Applicable to the Appeal Proceedings


R-14 Appeal

A party may appeal from the decision of the Executive Committee PRHSAA, insofar as the statutes or regulations of the said body so provide with regards to the rules of eligibility and disciplinary actions taken by the Executive Committee, in which the penalty/sanctions rendered by the
